| Stuart Sims, a member of Brock Clay's Litigation practice, is a trusted advisor to clients ranging from owners of small companies to CEOs of large enterprises, helping them develop and implement workable solutions to complex business problems in an uncertain economy. While his practice focuses primarily on business litigation, Mr. Sims’ goal is to keep his business clients out the courtroom by resolving issues before they become lawsuits. When litigation is necessary, Mr. Sims' objective is to always protect his clients' interests inside and outside the boardroom and the courtroom. He regularly litigates business disputes, including business divorces, shareholder derivative actions, trade secrets, restrictive covenant and unfair competition. REPRESENTATIVE CLIENT HIGHLIGHTS Some of Mr. Sims’ recent litigation highlights include: - Successfully defending a financial advisor in an action by Chase Investment Services, Inc., for alleged trade secret and restrictive covenant violations in a FINRA Arbitration in Boca Raton, Fl. The Arbitration Panel denied all relief sought by the Claimant and awarded attorneys’ fees, $50,000 in compensatory damages and other relief to Mr. Sims’ client.
- Successfully working out and restructuring distressed commercial loans on behalf of borrowers and guarantors across the Southeast.
- Successfully litigating Note and Guaranty suits across Georgia, including obtaining pre-trial dismissals of foreclosure confirmation petitions.
- Representing an international manufacturing corporation in the successful resolution of a multi-faceted shareholder dispute.
- Providing corporate representation to Grammy-nominated and Dove Award winning recording artists and founders of Christian music’s largest annual tour.
- Serving as lead litigation counsel in Georgia for a multi-national private equity firm’s commercial loan portfolio.
