Daniel Wirth, a member of Brock Clay's Litigation practice, represents clients in securities arbitrations; commercial litigation; contract disputes, including those involving restrictive covenants; and other employment and commercial litigation.

He also represents clients in employment discrimination and wrongful termination claims.

Mr. Wirth represents clients ranging from individuals and start-up companies to Fortune 500 financial services firms in a broad range of matters and jurisdictions.

He has significant experience representing clients in claims relating to misappropriation of trade secrets, employment discrimination, unfair competition, and claims relating to employees and officer’s duties of loyalties. Mr. With also represents securities broker-dealers and registered representatives in industry and customer disputes before FINRA arbitration panels.

Prior to joining Brock Clay, Mr. Wirth represented New York City in labor and employment law matters. During his tenure, he conducted discrimination trial work in matters covered by Title VII of the Civil Rights Act of 1964 and the Americans with Disabilities Act; appeared on labor arbitrations; and advised City management on workers compensation matters and disputes arising under collective bargaining agreements and civil service laws.

REPRESENTATIVE CLIENT HIGHLIGHTS

Some of Mr. Wirth’s recent notable litigation highlights include:

  • Serving as first chair in securities litigation, successfully prosecuting claims relating to margin debts and successfully defending against a customer’s suitability claims, receiving an award of attorneys’ fees.  
  • Serving as first chair in a securities litigation defending a broker-dealer against a customer’s claims of unsuitability, fraud and breach of fiduciary duty.
  • Successfully securing summary judgment in Federal Court against an employee’s claims of age discrimination.
  • Serving as second chair in a claim for defamation, violation of securities regulations and violation of operating agreement that resulted in a multi-million dollar settlement in favor of our client.
